Terms of Service

These terms govern your use of OpsCore and OpsCore Answer ("the Service"), operated by TDS E Solutions ("we", "us"). By creating an account or using the Service you agree to these terms.
The Service
OpsCore provides business software, including OpsCore Answer, an AI receptionist that answers phone calls on your business's behalf, converses with callers, takes messages, and delivers them to you. Features, plans, and included minutes are described at signup and on your Billing page.
Your account
- You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account.
- You must be authorized to act for the business you register.
Acceptable use
- Use the Service only for lawful business purposes.
- Do not use the Service to harass, defraud, or mislead callers, or to record calls where you lack the legal right to do so.
- You are responsible for the accuracy of the business information (hours, services, prices, FAQs) you give the receptionist to say on your behalf.
- Do not attempt to probe, overload, or disrupt the Service.
Use of artificial intelligence
The Service uses artificial intelligence, including to answer and conduct phone calls, transcribe and summarize them, and power in-product assistance. AI output can be inaccurate or incomplete, and you should not rely on it without review.
- Calls are answered by an artificial intelligence, not a person. It identifies itself as an AI when asked.
- AI-generated speech and transcripts can contain errors. The Service is not a substitute for emergency services, and the receptionist directs emergency callers to 911.
- You must not configure the receptionist to give medical, legal, or financial advice.
Call recording
Calls handled by the receptionist are recorded and transcribed so you can review your messages. The default greeting discloses recording to callers. If you replace the greeting, you are responsible for complying with call-recording and consent laws that apply to you and your callers.
Text message alerts
- Program: OpsCore Answer message alerts. When a caller leaves a message for your business, we text a short summary and a link to listen and reply to the people on your account who switched text alerts on.
- Opt-in: text alerts are off until you enter a mobile number and switch on “Text me when a caller leaves a message” in your console. You confirm you are the user of that number or are authorized to enroll it.
- Frequency: varies with how many messages your callers leave. Message and data rates may apply.
- Opt-out: reply STOP to any text to stop. Reply HELP for help, or email support@tdsesolutions.com.
- Carriers are not liable for delayed or undelivered messages. We do not share your number for marketing; see the Privacy Policy. Program details: opscore8.com/sms.
Billing
- Plans bill monthly or annually through Stripe. Plans include a monthly allowance of answered minutes; usage beyond it bills per minute at the rate shown at signup.
- Trials and promotional pricing convert to the standard plan price when they end, using the payment method on file.
- You can cancel any time from the Billing page; service continues to the end of the paid period. Fees already paid are non-refundable except where the law requires otherwise.
Your content
You own your business information, call recordings, transcripts, and messages. You grant us the rights needed to operate the Service on them — answering your calls, storing recordings, generating transcripts and summaries, and delivering notifications.
Service changes and availability
We aim for high availability but the Service is provided "as is" and "as available", without warranties of any kind. We may change or discontinue features with reasonable notice.
Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amounts you paid us in the three months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost business from a missed or mishandled call.
Termination
You may close your account at any time. We may suspend or terminate accounts that violate these terms, with notice where practical. On termination, phone numbers we provisioned for you are released and your data is deleted on the schedule in the Privacy Policy.
Disputes and arbitration
Please read this section carefully — it affects your legal rights.
- Talk to us first. Before starting any formal proceeding, email support@tdsesolutions.com describing the dispute; we both agree to try in good faith to resolve it within 60 days.
- Binding arbitration. Any dispute arising out of or relating to these terms or the Service that we cannot resolve informally will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, held in Harris County, Texas, or conducted remotely if both parties agree. Judgment on the award may be entered in any court with jurisdiction.
- Exceptions. Either party may bring an individual claim in small-claims court, or seek injunctive relief in court for intellectual-property infringement or unauthorized access to the Service.
- No class actions. Disputes are resolved only on an individual basis. Both parties waive any right to participate in a class action or class-wide arbitration.
- Opt-out. You may opt out of this arbitration agreement by emailing support@tdsesolutions.com within 30 days of first accepting these terms, with the subject "Arbitration opt-out" and your account email. Opting out does not affect any other part of these terms.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. We may update these terms; material changes will be notified in the Service, and continued use after notice constitutes acceptance.
